Challenge: Getting the bellwether cases to file in specific jurisdictions.
The same case with the same merits can have a very different value depending on where it’s filed. Different Judges from different jurisdictions can see things very differently. Nordstrom and Company were tasked with finding qualified claimants in specific areas of the country so trials could be successfully conducted and precedents could be set that would move the overall litigation forward. Since most marketing companies take the approach of advertising for and signing everything, also known as an inventory approach, we did the opposite.
We spent our time and effort pre-screening everyone who responded to our marketing campaigns, in essence, we tried to disqualify as many people as possible so we could focus on the claimants who had real injuries with real proof of use. What we determined through this approach is that the docket that we helped build had barely any falloff and the case values were tremendously higher than average.
When a trial firm wants cases that they can actually bring to court, there isn’t a better approach. Interestingly though, from an ROI perspective, this approach has a much better return especially when you realize that your firm isn’t wasting its time and resources on cases that will never monetize.
