Fraud in Mass Tort & Lead Generation

Challenge: Mass Tort Lead and Case generation fraud. With a shift in mass tort marketing and advertising from branded campaigns to the cost-per-retainer model, an influx of dual rep issues and retainer fraud has permeated most firms’ dockets. 


Unfortunately, most prove-ups happen late in the process and many firms delay ordering medical records until there is movement in the settlement negotiations. It’s no longer permissible to take the claimants at face value and most firms are ill-equipped to deal with managing large dockets let alone understanding how to recognize claimants that aren’t victims. Nordstrom and Company worked with 3rd party payers and healthcare providers to create a network of systems that now include almost 80% of all existing medical databases. Creating a category known as “PreQual”, we were able to move large dockets through API access to thousands of databases resulting in a qualification process that lets the law firm know who is real and who isn’t. It gives us insight into the medical record without having to order the record so law firms can devote their time and resources to helping actual victims who qualify for the litigation and remove fraudulent and unqualified claimants from their system.
